Basic Estate Plan uses a last will and testament to distribute your assets upon death. A will must be admitted to probate, and an executor must be appointed by the court, before assets subject to probate may be distributed. Therefore, probate proceedings are required to administer a basic estate plan. The other documents that are part of this plan may be used without probate.
